(1) Sail Your Way – Maja Žibert s.p. pays special attention to protecting the privacy of information obtained from users of these websites and personal data provided to it, in accordance with the applicable legislation on personal data protection in the Republic of Slovenia. (2) When handling your personal data, we implement measures designed to protect such data from loss, improper use, unauthorized access, disclosure, alteration, or destruction.
(3) In all cases, we cannot protect the data against any loss, improper use, unauthorized access, disclosure, alteration, or destruction, but we strive to prevent such unfortunate events.
GENERAL RULES FOR PROMOTIONS AND PRIZES
1. Definitions
(1) The organizer of the prize game is Sail Your Way – Maja Žibert s.p..
(2) The participant in the prize game is a person who participates in the announced prize campaigns.
(3) The winners of the awards shall be determined by the computer selection function at random or determined by the organizing committee.
2. The right to participate in the prize game
(1) Participants in the prize draw may be persons who are citizens of the Republic of Slovenia.
(2) Persons employed by the organizer of the prize game and their immediate family members and persons employed by other legal entities related to the implementation of this prize game may not participate in the prize game. Legal entities cannot participate in the prize draw. Persons who do not accept the rules of the prize draw cannot participate in the prize draw. It is considered that the participant has accepted the rules of the prize game by participating in the announced prize game.
3. Rules of participation in the prize game
You do not need to purchase the services or products of the prize draw organizer to participate in the prize draw.
4. Electronic prize draw
(1) All participants in the prize draw may participate in the draw. One participant can participate in the prize draw several times. The result of the draw is final. No appeal is possible.
(2) The winner will be notified of the receipt and method of receiving the prize by e-mail or other means of communication.
5. Obligations of the winner
(1) Payment of the prize in cash is not possible, nor can it be exchanged for another item. The winner is obliged to provide the organizer of the prize game in writing with his personal data – name, surname, address, e-mail address, and telephone number, no later than two (2) days after receipt of notification of the receipt of the prize.
(2) Payment of all taxes on prizes (including VAT) is the responsibility of the organizer. The organizer is not responsible for taxes that may arise in connection with any other prizes. If the winner does not fulfill all the obligations, it is considered that the winner does not want to accept the prize and thus the organizer is free from all obligations in relation to the winner after this prize game and acquires the right to dispose of the prize for any other purpose. Prizes are not transferable.
(3) If the organizer of the prize draw does not receive all the necessary information and a statement that he wishes to receive the prize within three working days from the moment he sends the winner a notification that he has been drawn, the winner shall be deemed to be the winner. he does not want to accept the prize, so the organizer is free of all obligations after the prize draw in relation to the winner and acquires the right to dispose of the prize for any other purpose.
6. Protection of personal data
(1) The organizer of the prize game protects all personal data obtained from the participants during the prize game in accordance with the regulations governing the protection of personal data. The organizer may use personal data obtained from participants exclusively for the purposes for which they were obtained.
(2) The participant in the prize game agrees that the organizer may send him notifications regarding the organizer’s offer. The participant or his guardian or legal representative may at any time revoke his consent to the use of personal data obtained in the prize draw for the purposes of direct marketing.
(3) The organizer of the prize game reserves the right to organize the award ceremony as a public event. By participating in the prize draw, the participant allows his / her name and address to be used in the audio, photo, and video material of the prize draw organizer. The winner allows the organizer of the prize game to publish his / her personal data in the media and on the World Wide Web for the purpose of informing about the results of the draw or receiving the prize.
7. Publication of the rules of the prize game
(1) By submitting their data, the participants in the prize game agree that they are familiar with the rules and undertake to act in accordance with the rules of the prize game.
(2) In the event of any dispute or ambiguity, these rules shall be considered primary in relation to any other publications, whether in printed, electronic, or any other form.
GENERAL TERMS AND CONDITIONS
1. Introductory provisions
(1) The General Terms and Conditions relate to the performance of the activities Sail Your Way –
Maja Žibert s.p., Glinškova ploščad 7, 1000 Ljubljana (registration in the Republic of Slovenia under
number 3161000137 on 17. 1. 2022, tax number 43385443).
(2) Sail Your Way – Maja Žibert s.p. urges all users to read the general terms and conditions in full.
The user is considered to be all persons who in any way use the services offered by Sail Your Way –
Maja Žibert s.p..
(3) General Terms and Conditions of Sail Your Way – Maja Žibert s.p. are compiled in accordance with
the Consumer Protection Act (Official Gazette of the Republic of Slovenia, No. 98/04 – official
consolidated text, 114/06 – ZUE, 126/07, 86/09, 78/11, 38/14, 19/15, 55/17 – ZKolT and 31/18), the
Personal Data Protection Act (Official Gazette of the Republic of Slovenia, No. 94/07 – official
consolidated text and 177/20) and the Electronic Communications Act (Official Gazette of the
Republic of Slovenia, No. 109/12, 110/13, 40/14 – ZIN-B, 54/14 – US decisions, 81/15 and 40/17).
2. Reservation procedure
(1) The user can make a reservation by submitting a reservation on the website Sail Your Way – Maja
Žibert s.p. or inform Sail Your Way – Maja Žibert s.p. by e-mail to info@sailyourway.net.
(2) The user who has made a reservation in the manner specified in the previous paragraph of this
chapter of the General Terms and Conditions is the main contact person. All communication
between Sail Your Way – Maja Žibert s.p. and to users through the main contact person who
submitted the reservation.
(3) The main contact person is responsible for handing over all information obtained by Sail Your
Way – Maja Žibert s.p. other participants (crew, cabin passengers, etc.) who are participants on the
basis of the reservation referred to in the first paragraph of this chapter of the General Terms and
Conditions.
(4) Sail Your Way – Maja Žibert s.p. will provide the main contact person with information on all
available facilities and costs. By providing the information to the main contact person, the main
contact person, and all participants to whom the main contact person is obliged to inform about the
reservation agree that Sail Your Way – Maja Žibert s.p.:
3. Cabin reservation procedure
(1) When booking a cabin, the user agrees that Sail Your Way – Maja Žibert s.p. independently
arrange for the allocation of a suitable cab to the user.
(2) In doing so, Sail Your Way – Maja Žibert s.p. undertakes to find the best option for the user.
Nevertheless, there is a possibility that certain persons who have been grouped together in a single
cabin or on a single vessel are not compatible with each other. In the event that such circumstances
arise, Sail Your Way – Maja Žibert s.p. cannot be held responsible for the situation and urges users to
find a common compromise.
4. Check-in application
(1) All guests (users) must register online or, if registration is not possible online, via the weblink
sent to users.
(2) Users who do not register in the manner specified in the previous paragraph of this chapter of
the General Terms and Conditions will have to pay an additional administrative fee of EUR 10 per
the person upon registration on the spot. Sail Your Way – Maja Žibert s.p. does not guarantee that the
on-site registration procedure will take place as quickly as the registration procedure in the first
paragraph of this chapter of the General Terms and Conditions.
(3) The online application for booking a vessel is available at least fourteen (14) days before the
planned date of the individual event. Also, online registration for cabin and stand-alone bookings will
be available at least fourteen (14) days prior to the scheduled date of each event.
(4) Upon the arrival of the user in his basic marina, the user must submit the following matters:
identification document (identity card or passport), and
– certificate of compliance with the PCT condition
(5) In the event that Sail Your Way – Maja Žibert s.p. finds that a person who does not meet the age
requirements set out in these General Terms and Conditions may wish to apply, Sail Your Way – Maja
Žibert s.p. prevents such a person from registering. In this case, the user is not entitled to a refund of
any amount paid. Sail Your Way – Maja Žibert s.p. also does not grant the user any additional costs
resulting from the breach of the age conditions.
(6) In case the user wishes to add an additional person to the crew list at the check-in point, Sail Your
Way – Maja Žibert s.p., if possible, allows him to add a person to the existing crew. In this case, Sail
Your Way – Maja Žibert s.p. entitled to an administrative fee of EUR 50 for each additional person.
The recorded administrative cost also applies in the event of deletion of a person or change of a
person from the crew list.
5. Price list
(1) The prices published on the Sail Your Way – Maja Žibert s.p. website is for information purposes
only and is subject to change at any time. Sail Your Way – Maja Žibert s.p. reserves the right to
change the prices published on the website at any time.
(2) In the event of a change in prices by Sail Your Way – Maja Žibert s.p. the user will be notified in a
timely manner. In the event of a price change, the user has the option to agree to a price change or
cancel their reservation. In the event that the user cancels his reservation due to a subsequent
change in prices, Sail Your Way – Maja Žibert s.p. obliges the user to refund the entire payment.
(3) Sail Your Way – Maja Žibert s.p. may change prices after booking by the user in the following
cases:
– Due to changes in the cost of fuel or other energy sources, changes in exchange rates, the amount
of taxes or fees imposed by third parties, including tourist taxes or fees for boarding or disembarking
in ports.
(4) Sail Your Way – Maja Žibert s.p. ensures that prices will not change in the last five (5) days prior to
the scheduled departure.
(5) In the event of an increase in prices due to cases not defined in the previous paragraph, except
for price increases that are subject to costs related to insurance premiums and all other allowances,
Sail Your Way – Maja Žibert s.p. will not change its price if the increase in the total price of the user's
travel arrangements is less than 2%. Sail Your Way – Maja Žibert s.p. will change its prices only by
increasing the total price of the user 's travel arrangements by more than 2%. In the event of an
increase of more than 8% in the price of the user's travel arrangement, the user has the following
options:
– In case an alternative term is available, the user can change his term, where Sail Your Way – Maja
Žibert s.p. return to the user any difference between the price of the original travel arrangement and
the replacement term.
– The user can cancel his reservation. In this case, Sail Your Way – Maja Žibert s.p. return to the user
all funds already paid.
(6) In case of cancellation, Sail Your Way – Maja Žibert s.p. reserves the right to charge administrative
fees for cancellations, which may not exceed EUR 50.
(7) Prices do not include the corresponding food costs for the skipper or host included in each
package. Users must provide the skipper and/or host with at least three (3) meals per day at their
own expense. At the same time, users must provide the required meals at a reasonable time.
(8) By default, all prices on the website and on various documents (booking certificates, pro forma
invoices, etc.) are expressed in EUR.
6. Payments
(1) The user makes all payments to the account Sail Your Way – Maja Žibert s.p. upon receipt of a
confirmation email and confirmation account.
(2) The default payment currency on the account is in € (EUR). If the user chooses to pay with any
other currency displayed on the Sail Your Way website – Maja Žibert s.p., or through an adjusted
offer, the quoted price may change depending on exchange rate fluctuations, including the internal
exchange rate set by Sail Your Way – Maja Žibert s.p. may be included in all future payment
transactions.
(3) The payment plan for any installments may differ depending on the event and the destination
reserved by the user. Sail Your Way – Maja Žibert s.p. will inform the user before issuing the
confirmation invoice about the actual payment plan of each user's reservation.
(4) For most events and destinations, the payment plan is as follows:
– 10% of the total cost of the reservation, which is considered non-refundable security, except in
case of force majeure, the user must pay immediately upon booking
– 40% of the total cost of the reservation, the user must pay no later than 15 days from the date of
booking, if the event is more than 84 days,
– 50% of the total cost of the reservation, the user must pay no later than 15 days from the date of
booking, if the event is less than 84 days,
– the difference of up to 100% of the total cost of the reservation, the user must pay no later than 30
days from the date of the event,
– for bookings made within 90 to 60 days before the date of the event, the user must pay 40% of the
total cost of the booking when booking,
– for reservations made within 60 to 30 days before the date of the event, the user must pay 60% of
the total cost of the reservation when booking,
– for reservations made less than 30 days before the date of the event, the user must pay 100% of
the total cost of the reservation at the time of booking.
(5) In case of non-payment of an individual installment by the due date, Sail Your Way – Maja Žibert
s.p. reserves the right to cancel the reservation and withhold all already paid parts of the
reservation.
(6) In the event that circumstances arise that prevent the user from fulfilling his obligation to pay
individual installments to Sail Your Way – Maja Žibert s.p., Sail Your Way – Maja Žibert s.p. invites the
user to inform him immediately.
(7) Exceptionally, in the case referred to in the previous paragraph of this point of the General Terms
and Conditions, Sail Your Way – Maja Žibert s.p. may offer an extension of the payment deadline.
(8) Payments must be made from the current account of the main contact person. In the event that
the payment was transferred from another current account, Sail Your Way – Maja Žibert s.p.
reserves the right to obtain written authorization from the main contact person of the current
account holder from which the payment was made.
7. Cancellation policies and variations
(1) Sail Your Way – Maja Žibert s.p. prepares information on each reservation in advance. At the
same time, there is a possibility of minor changes to the already confirmed reservation (for example:
change of skipper, change of DJ, minor changes of the route due to weather or local restrictions).
(2) In the event of major changes to the confirmed reservation (for example change of dates,
changes of accommodation), users will be immediately notified of the planned change.
(3) In the case referred to in the previous paragraph of this point of the General Terms and
Conditions, the user has the following options:
– the user can cancel his reservation and Sail Your Way – Maja Žibert s.p. return to the user the entire
amount paid or part of the amount paid in accordance with Chapter Six of these General Terms and
Conditions;
– the user can confirm and accept the changes;
– the user can, as far as possible, make a completely new reservation.
(4) The user must communicate his decision from the previous paragraph of this point of the general
terms and conditions Sail Your Way – Maja Žibert s.p. within three (3) working days from the day the
user was by Sail Your Way – Maja Žibert s.p. informed of the change of reservation.
(5) Sail Your Way – Maja Žibert s.p. to you in the event of a change resulting from force majeure and
to which Sail Your Way – Maja Žibert s.p. cannot influence or prevent it, return the entire payment or
part of the payment, as specified in the ninth paragraph of this point of these General Terms and
Conditions.
(6) Examples to which Sail Your Way – Maja Žibert s.p. it cannot be affected in particular by
dangerous weather conditions, pandemics, epidemics, fires, industrial actions, war, riots, and natural
disasters. In these cases, the scope of user rights may be reduced in line with WTO
recommendations.
(7) In the event that the vessel selected by the user at the time of booking is not available, Sail Your
Way – Maja Žibert s.p. inform the user thereof as soon as possible. Sail Your Way – Maja Žibert s.p.
reserves the right to cancel the user's existing reservation or offer the user a replacement vessel.
(8) If a replacement vessel is offered to the user, users may receive either an upgrade (a
replacement vessel is more expensive and better than the originally reserved vessel) or a
replacement vessel which does not constitute an upgrade but is of the same quality as the originally
reserved vessel.
(9) Sail Your Way – Maja Žibert s.p. return the paid amount or part of the paid amount to the user
due to the cases specified in the sixth paragraph of this point of the general terms and conditions
under the following conditions:
– 100% more than 84 days from the date of the event,
– 60% in the period from 83 days to 1 day from the date of the event,
– 50% less than 1 day from the date of the event.
(10) In case the user wants to change his reservation (variation), he must immediately inform Sail
Your Way – Maja Žibert s.p. is the main contact person of the user. In the event of costs incurred as a
result of a change in the reservation by the user, they are charged to the user.
(11) In the event that change at the request of the user is not possible or feasible, Sail Your Way –
Maja Žibert s.p. assumes no responsibility.
(12) Sail Your Way – Maja Žibert s.p. reserves the right to charge any requested and actually made
change in the amount of € 50.00.
(13) In case of change of vessel or reservation dates by the user, Sail Your Way – Maja Žibert s.p.
entitled to charge the amounts specified in paragraph (3) three of the ninth point of the General
Terms and Conditions.
8. Cancellation by Sail Your Way – Maja Žibert s.p.
(1) Sail Your Way – Maja Žibert s.p. reserves the right to cancel the user's reservation at any time.
(2) In the event that the cancellation of the reservation by Sail Your Way – Maja Žibert s.p. Due to
circumstances that are not defined as an exceptional case in the fifth and sixth paragraphs of the
previous point of the General Terms and Conditions, the user is entitled to a refund of the full
amount of the payment.
(3) In the event of cancellation due to exceptional circumstances specified in the fifth and sixth
paragraphs of the previous general terms and conditions, the user is entitled to a refund of the full
amount of payment or work in accordance with the ninth paragraph of the previous general terms
and conditions.
9. User Cancellation
(1) The user must notify Sail Your Way – Maja Žibert s.p. as soon as possible. When the appropriate
notice of cancellation counts a cancellation by email or by phone call.
(2) The user agrees that the refund of the amount paid and the amount thereof depends on the
conditions set out in these general terms and conditions.
(3) In case of cancellation of the reservation of the vessel, cabin or individual reservation by the user,
Sail Your Way – Maja Žibert s.p. reserves the right to charge cancellation fees according to the
following rules:
– 0% of the amount of the reservation in case of cancellation less than 24 after the reservation,
– 40% of the amount of the reservation in case of cancellation more than 24 hours and less than 15
days after the reservation or 60 days before the date of the event (whichever occurs first),
– 50% of the reservation amount in case of cancellation less than 59 days and more than 1 day
before the date of the event,
– 100% of the booking amount in case of cancellation less than 24 hours before the date of the
event.
(4) The user is also obliged to pay other costs related to the cancellation (for example, costs of other
suppliers or other costs incurred by Sail Your Way – Maja Žibert s.p. and which Sail Your Way – Maja
Žibert s.p. cannot influence).
(5) In the case referred to in the previous paragraph of this point of the General Terms and
Conditions, Sail Your Way – Maja Žibert s.p. reserves the right to withhold the paid-in funds and
settle the obligations arising from the previous paragraph of this item of the General Terms and
Conditions.
(6) In the event of unforeseen circumstances (force majeure) occurring in or near the destination
and to which Sail Your Way – Maja Žibert s.p. has no influence and cannot prevent them, users can
withdraw from their reservation at any time. In this case, the user is entitled to a refund of 50% of
the amount paid.
(7) In the event that the user has a travel insurance policy that includes the risk of cancellation, the
user must inform Sail Your Way – Maja Žibert s.p. in Sail Your Way – Maja Žibert s.p. and the user will
find a favorable solution together.
10. Adding a user (event participant)
(1) Adding a user (participant in the event) is possible only with the prior consent of Sail Your Way –
Maja Žibert s.p.. Request to add a user must be made no later than the date by which the last
payment of the event must be made.
(2) Adding a user may incur additional costs. The user will be informed about these costs by Sail Your
Way – Maja Žibert s.p..
(3) Sail Your Way – Maja Žibert s.p. is not responsible for providing the ability to add a user.
11. Change of user (participant in the event)
(1) In the event that any person who was listed as a user of the Sail Your Way services at the time of
booking – Maja Žibert s.p. (crew member), unwilling or unable to attend the booked event, the main
contact person must inform Sail Your Way – Maja Žibert s.p. no later than 7 days before the date of
the event.
(2) The main contact person may be Sail Your Way – Maja Žibert s.p. communicates data on the
alternate user (participant in the event). In case it is possible to change the participant of the event,
Sail Your Way – Maja Žibert s.p. entitled to reimbursement of administrative costs related to the
change of participant in the event in the amount of € 50.00.
(3) In the event of a change of participant, the main contact person guarantees that the substitute
participant has become acquainted with the general terms and conditions of Sail Your Way – Maja
Žibert s.p..
12. Vessel specification
(1) Vessel specifications, vessel measurements, data on companies that lease vessels, and other data
related to the characteristics of an individual vessel, users can find on the website Sail Your Way –
Maja Žibert s.p. or in a customized offer sent to the user via email. Sail Your Way – Maja Žibert s.p.
does not guarantee the truthfulness and correctness of the information provided on its website.
(2) The vessel in question will be assigned to the user no later than 14 days before the date of the
event. Upon assignment of the vessel, the user will also be provided with more detailed information
on the vessel and the marina in which the vessel is located and on the securities that need to be paid
at the location of the vessel.
(3) All images of vessels published on the Sail Your Way website – Maja Žibert s.p. are intended
for general presentation only and do not necessarily reflect the actual appearance of an individual
vessel. The images are symbolic.
(4) Sail Your Way – Maja Žibert s.p. does not guarantee that the assigned vessel will be exactly the
same as the vessel published in the figure on the Sail Your Way website – Maja Žibert s.p.
(5) Notwithstanding the preceding paragraph, Sail Your Way – Maja Žibert s.p. urges users to report a
discrepancy between the published image and the vessel actually received. Sail Your Way – Maja
Žibert s.p. guarantees that it will seek to remedy the error committed by the chartering company.
13. Vessel deposit
(1) Upon arrival at the marina, the company renting the vessel may request the payment of a
security deposit intended for additional cleaning, possible damage to the vessel, and the like.
(2) The amount of the security determined by the company renting the vessel shall cover any costs
on the entire vessel. Payment of the deposit is usually possible with payment or credit cards, but Sail
Your Way – Maja Žibert s.p. does not guarantee that this payment option is available in all locations.
Sail Your Way – Maja Žibert s.p. recommends that the user be informed in advance of the method of
payment of the security.
(3) When renting certain vessels, there is a possibility that the user pays a non-refundable deposit or
non-refundable security instead of paying a security deposit, which is returned to the user-provided
that no damage was caused to the vessel, which would be covered by the paid security. The non-
refundable security deposit is usually lower than the repayable security deposit. Sail Your Way –
Maja Žibert s.p. points out that the non-refundable security deposit is non-refundable even if no
damage has occurred to the vessel.
(4) A contractual relationship relating to both repayable and non-repayable securities shall be
concluded between the user and the company renting the vessel. Sail Your Way – Maja Žibert s.p. is
not responsible for the return or loss of the security paid.
14. Check-out
(1) The main contact person of the user or the individual who actually paid the security deposit for
the vessel must be present at the check-out or return of the vessel.
(2) In the event that the person referred to in the previous paragraph of this General Terms and
Conditions is not present at the check-out or return of the vessel, and there are reasons (such as
damage to the vessel) due to which the security cannot be paid in full, the user and the entire crew
security or, in certain cases, if the damage is greater, the loss of the entire security.
(3) Sail Your Way – Maja Žibert s.p. does not assume any liability related to the return of the security
paid
(4) The scheduled check-out or return of the vessel takes place at the agreed time written in your
package. Sail Your Way – Maja Žibert s.p. ensures that the user arrives at the marina in question by a
certain time. Regardless, Sail Your Way – Maja Žibert s.p. is not responsible for any trips or voyages
after check-out or return of the vessel.
15. Individual reservation program
(1) The implementation of an individual program, which is included in an individual reservation and
consequently the route that was originally planned, may change due to weather conditions. Sail Your
Way – Maja Žibert s.p. is not responsible for any changes to the program due to force majeure and to
which Sail Your Way – Maja Žibert s.p. cannot influence or prevent them.
(2) Sail Your Way – Maja Žibert s.p. will send the approved program (including the route) to the user
no later than 14 days before the date of departure of the user. Subject to the previous paragraph of
this point of the General Terms and Conditions, Sail Your Way – Maja Žibert s.p. is not responsible
for these changes.
16. Transport
(1) Each reservation or event does not include the transport of the user to the location of departure
and the transport from the location of arrival to the user's address. These transports must be
provided by the user.
(2) Sail Your Way – Maja Žibert s.p. shall not be liable for any damage resulting from the delay due to the
fault of the user.
17. Passports and visas
(1) The user is independently responsible for having valid travel and other documents. Users must
also independently obtain valid visas or other documents required in a particular country, including
any countries of transit.
(2) Sail Your Way – Maja Žibert s.p. cannot assist the user in obtaining the documents referred to in
the previous paragraph of this chapter of the General Terms and Conditions. Sail Your Way – Maja
Žibert s.p. nor is it liable for any damage resulting from improper sheets.
18. Travel insurance
(1) Sail Your Way – Maja Žibert s.p. does not sell travel insurance. Users must take out the
appropriate travel insurance on their own. Users are advised to take out travel insurance, which
includes:
– cancellation insurance,
– loss and theft of personal property,
– coverage of adventure activities.
(2) Sail Your Way – Maja Žibert s.p. is not liable for any damage resulting from inadequate travel
insurance of the user.
(3) Any claims from the user's travel insurance must be addressed to the travel insurance issuer and
not to Sail Your Way – Maja Žibert s.p..
19. User Responsibility
(1) In the event that the User acts in a manner that poses a danger to him or other persons, whether
his actions cause damage to other persons and property or violate local law or are in any way
offensive or threatening or his conduct causes a violation of public order or peace or does not follow
the instructions or orders of the skipper or any representative Sail Your Way – Maja Žibert s.p., you
Sail Your Way – Maja Žibert s.p. reserves the right to cancel the reservation immediately without
refunding any amount paid by the user.
(2) Sail Your Way – Maja Žibert s.p. also reserves the right to prevent the user, who acted in the
manner referred to in the previous paragraph of this point of the General Terms and Conditions,
from participating in all future events organized by Sail Your Way – Maja Žibert s.p..
(3) Users may use external sound systems (speakers), but may not use them in an individual marina
after 8 pm.
(4) Any event booked through Sail Your Way – Maja Žibert s.p. may pose a certain risk to the user. By
making a reservation, you agree that you attend the event at your own risk and that you are
responsible for all your actions.
(5) By accepting these general terms and conditions, the user agrees to assume all responsibility for
damage caused by the user or any other person listed on the reservation.
(6) The user is required to do so in a moderate and responsible manner in the case of the
consumption of alcoholic beverages.
(7) Sail Your Way – Maja Žibert s.p. leads to zero tolerance to illicit substances. In the event that it is
established that a user or any other person has used a Prohibited Substance, Sail Your Way – Maja
Žibert s.p. the right to cancel your reservation or disembark you from the vessel at your own costs
and to inform the competent law enforcement authorities about the event.
(8) The user agrees that the skipper assigned to the vessel in question is responsible for the vessel
being leased. The skipper decides on behalf of the vessel on the basis of safety, general consent of
the crew, and local knowledge and experience related to weather and circumstances. Sail Your Way –
Maja Žibert s.p. is not responsible for any changes that depend on the judgment of the skipper.
(9) The user must fully comply with the instructions and rules applicable to each vessel. In the event
of damage (physical or material) on the part of the user due to non-compliance with the instructions
and rules of the vessel, the user is fully responsible for the damage. The user participates in all
activities at his own risk and is in every sense responsible for his actions and safety.
(10) The user is fully responsible for his personal property and property. Sail Your Way – Maja Žibert
s.p. is not responsible for any loss or theft of personal property and property of the user.
(11) In case of loss or theft of property, the user must inform Sail Your Way – Maja Žibert s.p.
immediately. Sail Your Way – Maja Žibert s.p. will in most cases try to help find property or property.

performed meet the standard reasonably expected by persons qualified to offer and perform such
services. In performing contractual obligations to the user, we use reasonable care and skill in
accordance with the laws and regulations of the country in which the event takes place.
(2) Sail Your Way – Maja Žibert s.p. comply with local and national regulations and the laws of the
country in which it operates. The user agrees that the overseas security standards or the standards
of any component of the user's holiday booking may differ from those in the user's country and in
some cases may not meet the standards used by the user in the home environment (eg air
conditioning, refrigeration, Wi-Fi, and toilets).
(3) In case the user needs additional services due to health reasons, such as refrigeration or air
conditioning services, he must inform Sail Your Way – Maja Žibert s.p., who will try to provide
additional services. In the event that Sail Your Way – Maja Žibert s.p. cannot provide additional
services, will inform the user. Sail Your Way – Maja Žibert s.p. is not responsible for the inability to fulfill.
(4) Obligations Sail Your Way – Maja Žibert s.p. and the obligations of its suppliers to provide
reasonable care to users is met in accordance with local laws or local customs.
(5) The user must immediately inform Sail Your Way – Maja Žibert s.p. on any non-fulfillment or
improper performance of all services subject to the operation of Sail Your Way – Maja Žibert s.p. and
areas such included in an individual event. In the event that certain services are not performed in
the manner guaranteed by Sail Your Way – Maja Žibert s.p., the user may in certain cases be entitled
to a price reduction or other compensation for the situation.
(6) Notwithstanding the preceding paragraph, Sail Your Way – Maja Žibert s.p. assumes no
responsibility for non-performance or improper performance of all services subject to the operation
of Sail Your Way – Maja Žibert s.p. and are included as such in an individual event if the non-
the performance or improper provision of services is due to:
– the conduct of the user or any of its participants,
– acts or omissions of a third party that are not related to the provision of package travel services
and which are unpredictable and unavoidable,
– unavoidable and extraordinary circumstances.
(7) Sail Your Way – Maja Žibert s.p. nor is it liable for any damage (physical or material) caused by the
user by disregarding the instructions and rules of the individual vessel.
(8) Liability Sail Your Way – Maja Žibert s.p. is in all cases, except in the case of death or personal
injury limited to three times the price of the booked experience.
(9) Sail Your Way – Maja Žibert s.p. is not responsible for compensation in case of lost flights or
reimbursement of flight costs.
(10) Where any claim or part of a claim (including those involving death or personal injury) concerns
or is based on any travel arrangements or sailing experience or courses, the maximum amount of
compensation by Maja Žibert s.p. restricted in accordance with all relevant international conventions
or regulations.
(11) The user is obliged to help Sail Your Way – Maja Žibert s.p. in recovering from any third party the
amount that could compensate for all amounts paid to you by Sail Your Way – Maja Žibert s.p.. In
particular, the user is obliged to assign all rights to any other person whose acts or omissions are
caused or contributed to the responsibility of Sail Your Way – Maja Žibert s.p. to the user.
21. Photography
(1) Sail Your Way – Maja Žibert s.p. you can photograph and record the event with a video camera
during the performance of an individual event.
(2) By booking via Sail Your Way – Maja Žibert s.p. the user agrees that Sail Your Way – Maja Žibert
s.p. also uses captured photos and videos for commercial purposes. In doing so, Sail Your Way –
Maja Žibert s.p. crop, modify, combine, merge or otherwise edit images and video content as
needed. In the case of images and videos from the previous sentence Sail Your Way – Maja Žibert s.p.
takes ownership of these images and videos.
(3) Sail Your Way – Maja Žibert s.p. reserves the right to assign, assign, transfer or otherwise assign
rights and ownership to a third party as described in the previous paragraph. This extends to, but is
not limited to, employees, independent contractors, partners, sponsors, and other entities or
persons authorized by Sail Your Way – Maja Žibert s.p. to capture content for any authorized
purpose, whether for commercial or personal use.
(4) In case the user does not want to be shown in photos or videos, he must inform Sail Your Way –

(5) Users agree that all photographs and videos will be used solely for their own personal purposes

of such photographs and videos.
22. Excursions and other activities
(1) Users may also opt for separate excursions and other activities. Separate excursions and other
activities are not part of the package you have concluded with Sail Your Way – Maja Žibert s.p.. All
excursions and other activities are subject to a contractual relationship between the user and the
provider of excursions and other activities.
(2) Sail Your Way – Maja Žibert s.p. is not responsible for providing excursions and other activities as
well as is not responsible for conducting excursions and other activities. Users for separate trips and
activities enter into a contractual relationship with the actual organizer of trips and other activities.
Excursions and other activities are completely separate from the services provided by Sail Your Way –

23. Additional assistance

with appropriate assistance, in particular information on health services, local authorities, consular
assistance, etc.
(2) For additional assistance, users can call the telephone number (INSERT TELEPHONE) or send us a
message to the e-mail address (INSERT E-MAIL ADDRESS). If the problems arose as a result of the
user's independent decisions and the problems were caused by the user's fault, Sail Your Way – Maja
Žibert s.p. it does not take any responsibility for the problems that arise and the user is obliged to
solve them himself.
24. Resale
(1) Sail Your Way – Maja Žibert s.p. does not allow the resale of its products and services
without written consent.
25. Disabled people and clients with special requirements or needs
(1) In case of special requirements or needs, the user must inform Sail Your Way – Maja Žibert
s.p. in advance. he cannot be held liable for any damage or other circumstances that would
affect the performance of the ordered services and is consequently not obliged to reimburse any
possible costs.
(2) In the event that the user has certain health problems or problems with mobility or disability
and these problems could affect the course of the event, Sail Your Way – Maja Žibert s.p.
requires the user to provide a medical certificate or other documentation.
26. Complaints
(1) In case the user is not satisfied with the implementation of any element of the reservation
made on the website Sail Your Way – Maja Žibert s.p., he can address his complaint directly to
Sail Your Way – Maja Žibert s.p. days from the occurrence of the grounds on which the appeal is
lodged.
(2) The user may submit his complaint in writing or orally. The written form is considered to be a

of these Terms and Conditions is illegal, otherwise invalid or unenforceable, that provision or
